  • Each and every industry is classified under the Red category, Orange category, Green category, and White category and polluting in nature whether air polluting, water-polluting, and hazardous waste generating, these industries are covered under the consent management system. Under the consent management system, industries need to take a prior no objection certificate for setting up plant and machinery and for the operation of this equipment with respect to pollution angle from the Pollution control board. Pollution NOC refers to the pollution certifications for the establishment and the operation of the unit which are generally called CTE (Consent to Establish) and CTO (Consent to Operate).
  • In some Pollution control board states like Uttarakhand (UEPPCB), it is called CCA NOC because operation and authorisation permission is granted altogether.
  • The Pollution certificates and TSS (Total suspended solids) Total Suspended Solids = Total Solids –Total Dissolved Solids (Dry Weight of Filter and Trapped Material – Dry Weight of Filter)/Volume of Water Sample NOCs are generally covered under the provisions of The Air (Prevention and Control of Pollution) Act, 1981 and The Water (Prevention and Control of Pollution) Act, 1974 and Environment Protection Act 1986.
  • No construction and operation of any Industrial unit and establishment are allowed without taking the Pollution NOC and Pollution certificate from the State Pollution Control Board. Those factories running and operating with the Pollution license from the Pollution Board are deemed to be illegal and the Pollution control board is authorised under the provisions of Air Act 1981 and Water Act 1974 to cut the water and electricity supply of any defaulting unit.
  • We will discuss the types of Pollution consulting further. Pollution NOC can be divided into two types of certificates which shall be talked about in detail furthermore.
  • CTE NOC which is also known as Pollution NOC is given permission to start the construction at the project site from the Pollution Control Board.
  • In other words, It is a pre-establishment certificate for a Pollution certificate that allows the CPCB categorised industrial and non-Industrial Project and units to set up their plant and machinery and any other Pollution control device and equipment to control the Water Pollution and Air Pollution such as STP (Sewage Treatment Plant) It is a biologically process-based system that is used to treat domestic sewage or wastewater. E.g. Residential Apartments generate domestic or toilet waste which is cleaned and treated in the STP. ETP (Effluent Treatment Plant) ETP is a physio-chemical-based wastewater treatment system that is used to reduce the organic load from industrial wastewater. and Chimney and stack Scrubbers.
  • The State Pollution Control Board grants the Pollution certificate in compliance with  Section 25, Section 25 refers to no industry, process, project, factory, or any other unit or set up shall establish or operate in any manner without taking prior permission or consent from the State Pollution Control Board that is likely to generate and discharge the effluent or sewage or wastewater into a stream or well or sewer, or on land. , Section 26, and  Section 27 Section 27 refers to the refusal of the consent of the State Pollution Board. Section 27 of the Water Act gives power to the state board not to grant any establish and operate permission of any factory or set up. If any industry has been granted permission, then the board has the right to review those conditions attached with the approval. of the Water (Prevention and Control of Pollution) Act, 1974 and Section 21 of the Air (Prevention and Control of Pollution) Act, 1981 No person will without the prior consent of the State Pollution Board, establish or operate any industrial unit or set up or factory plant in an air pollution control area. and other pollution control laws.

  • The manufacturing process and process Flow Chart
  • Design Scheme of Effluent Treatment Plant and  Sewage Treatment Plant, Air Pollution Control Devices, and Hazardous Waste Management 
  • Forest NOC from District Forest Officer and Deputy Commissioner for areas covered under Aravali Notification
  • Wildlife NOC if falling under the protected area of National Park or Sanctuary    
  • Environmental Clearance letter in case of the projects covered under EIA NOC Notification dated 14th Sep 2006
  • Layout plan or layout plan
  • Board of Resolution, Power of Attorney, authorisation letter to signing the application and other correspondences
  • NOC CTE fee and performance security/Bank Guarantee which depends upon the project investment/cost ( Land, Building, and Plant Machinery cost)
  • Undertaking and affidavits
  • Groundwater NOC, CGWA permission, and CGWA NOC from the CGWA and State Government 
  • If the unit is engaging in the transportation of hazardous chemicals, details of chemicals transported, method, and its safety measures
  • Detailed Proposal for installation of Continuous Online monitoring system as per the norms for wastewater and for Emissions as the case may be
  • Forest NOC and Wildlife NOC and any other NOC if the project falls in Eco-sensitive zones, protected forest Areas, wildlife protected areas, sanctuary, TTZ area (Taj Trapezium Zone)
  • The validity of the consent to establish NOC depends upon the categorisation of the industries into Red, Orange, and Green and White in which a project unit falls.
  • For Red category project -1 year to up to 3 years
  • For Orange category project – 2 years to up to 5 years
  • For Green category project – 1 year to up to 10 years
  • Consent to establish NOC can be renewed and extended up to more years from the date of expiry of the period of the first CTE granted subject to the validity of EC ( if applicable)
  • Consent to Operate a Pollution NOC permission awarded by the State Pollution Control Board to any Residential, Commercial, industrial units, and non-industrial entities before the operation of the plant and machinery and other devices installed in order to control the Water Pollution It is a process of toxification of water bodies such as rivers, lakes, ponds, etc resulting in the change of physical, chemical, and biological properties of water that is not suitable to use. and Air Pollution It is a process of release of Solid and gaseous pollutants into the atmosphere that can be harmful to the health of living things on the earth. such as Effluent Treatment Plant to treat the wastewater generating from the factory production process and the Bag filters, cyclone separator, Electrostatic Precipitator, and water scrubber to prevent the solid and gaseous pollutants into the Air Environment.
  • This Pollution certificate is awarded in regulations with The Air (Prevention and Control of Pollution) Act, 1981 and The Water (Prevention and Control of Pollution) Act, 1974 and Environment Protection Act 1986.

  • Design Scheme of Effluent Treatment Plant and Sewage Treatment Plant.

  • Borewell CGWA NOC from the CGWA.
  • Proposal for online monitoring system for the effluent and Emissions as applicable.
  • OC (Occupational certificate) issued by Development Authority and DTCP and municipal corporation. 
  • Water NOC and Sewer NOC.
  • The validity of the consent to establish NOC depends upon the categorisation of the industries into Red, Orange, and Green and White in which a project unit falls.
  • For Red category project -1 year to up to 3 years
  • For Orange category project – 2 years to up to 5 years
  • For Green category project – 1 year to up to 10 years

  • CCA NOC is the combined Pollution NOC that is granted under the provisions of the Water Act 1974, Air Act 1981, and EP Act 1986 for the Polluting and Non-Polluting Industries. It is a one-time permission under the Pollution control laws that make the Industrial units eligible to have consent to operate and hazardous waste authorization in one shot. 
  • Some Pollution Control Board like UEPPCB (Uttarakhand Environment Protection & Pollution Control Board) Uttarakhand etc. has the practice to award the CCA NOC after complying with the statutory requirement of the UEPPCB. 
  • Before applying CCA NOC, It is mandatory for any project or unit to obtain the CTE – Pollution NOC under the provisions of the Water Act, Air Act, and EPA 1986. 
  • CCA NOC is awarded for five years for the orange category industries and for 1 year for the red category units.
