    Forest NOC and Forest Clearance from MoEF

    • It is a “No Objection Certificate” issued by the Forest Department.
    • Forest Clearance is required for any activity involving land within protected areas (sanctuaries, national parks) or reserved forests defined by the Indian Forest Act, of 1927.
    • It also acts as a confirmation that the proposed activity does not violate forest conservation regulations.
    • The project proponent and user agencies must acquire Forest Clearance from the Forest and Environment Department before using forest land for non-forestry purposes. This is required under Section 2 of the Forest Conservation Act, of 1980.
    • For any project or activity that requires Forest, Environment, Wildlife, or CRZ Clearances at the District, State, or Ministry of Environment & Forest level, the concerned parties must submit detailed proposals for prior approval to the respective departments.

    Why Forest Permission is required to obtain from MoEF?

    Forest NOC is a permit to access forest land for specific purposes. You will need the NOC from the Forest department under the following situations:

    • Protected areas and reserved forests: This includes sanctuaries, national parks, and designated forest areas under the Indian Forest Act (1927). Any activity requiring land or even just access (roads, pipelines) within these areas needs a prior Forest Clearance from MoEF.

    Wildlife NOC and NBWL Clearance

    Before starting any project that might impact wildlife habitats, you need a Wildlife NOC (No Objection Certificate) under the Wildlife Protection Act, 1972.

    Any project that requires the diversion of land or habitat of wildlife under the Wildlife Protection Act 1972 must obtain Wildlife Permission or NBWL permission (National Board for Wildlife).

    Who needs NBWL's NOC for Wildlife Clearance?

    Wildlife NOC applicability applies to the following entities: 

    • Activities requiring land or habitat diversion: This includes construction, infrastructure development, resource extraction, or any activity impacting protected areas like national parks and sanctuaries, or other notified forests.
    • Projects proposed by any user agency: This includes government departments, public sector undertakings, and private companies.

    Who approves the Wildlife Clearance Projects?

    • The National Board for Wildlife (NBWL) Standing Committee grants permission for certain activities, while others are strictly prohibited by the Ministry of Environment & Forests.
    • According to the Wildlife (Protection) Act, 1972, and the Hon’ble Supreme Court Orders dated 9th May 2002, any activity that is not related to forestry within a National Park or Sanctuary requires clearance from the Standing Committee of NBWL.
    • Never start an activity without a Wildlife NOC. The user agency or project proponent must seek this approval before proceeding.

    Aravali NOC from the Ministry of Environment & Forest

    Aravali Region Restrictions: Understanding the MoEF Notification

    Obtaining an Aravali NOC (No Objection Certificate) from the Ministry of Environment & Forests (MoEF) is mandatory for certain activities within the region. This requirement stems from the MoEF notification dated 7 May 1992, issued under the Environment (Protection) Act, 1986, and its rules.

    Areas where any Planning activities are prohibited under the Aravali Notification 1992?

    The Aravali MoEF notification dated May 7, 1992, restricts certain activities in specific areas to protect the environment. These restrictions apply to:

    • Land Recorded as “Forest”: Any land classified as “forest” in official land revenue records of Gurgaon district (Haryana) or Alwar district (Rajasthan).
